Re: Trademark Search and Clearance

Prof. Partridge, I agree with you when you say that sometimes searching and clearance of trademarks is considered a low level function. However, what people do not realize is that this is a very important step for example when considering filing a trademark application for registration in order to avoid future disputes/ actions filed by third parties whose rights may be affected. Even though, when doing searching and clearance, in my opinion there is no 100% guarantee that our client’s trademark application will not be subject of an opposition procedure, this step will give us, counsels; a wider view to see what we are facing or the possible future disputes which could arise in the event there are similar third parties trademarks in the market.
