Who Owns Obama Poster Rights?

When an artist creates a poster using another's photograph, who owns the rights? Photographer? Artist? Subject? Someone else? Consider this report on claims involving the famous Obama poster we seem to see everywhere.

This is the oddest thing. Fairey did not sell or collect any funds for the Obama poster, according to an interview that took place weeks before the suit was filed. The Obama Campaign adopted the image as the official Obama campaign poster, and Fairey allowed it because he supported the campaign. It was clearly political. I can understand AP needing to send a message that it will protect it's photos, however in picking and choosing your battles I would've avoided this situation because he changed the photo for political reasons, the party he gave the painting to WON the election. So Fairey is likely a friend to the Obama squad. If I was AP I would've let this one go because this could turn into that classic PUBLIC RELATIONS NIGHTMARE OF the big bad company going after the little innocent artist expressing his political views.
