View Article  The Fifteen Percent Solution to Trademark Infringement

It's important to learn something new every day.  Here's mine for the day from an article in the Whitter Daily News:

The firefighters researched trademark law and learned that if the image is altered at least 15 percent, it is not considered a trademark infringement.

I've been at this over 20 years, and this is the first time I've hear the 15 percent rule in trademark law.  Sure makes things easy!

The story involves T-shirts sold by firefighters in Whitter, California, featuring a logo admittedly similar to the Quaker Oats man.

View Article  Beanie Babies Liable For Witness Tampering in Trademark Infringement Case

The Chicago Tribune reports on a judgment against Ty Inc., the maker of BEANIE BABIES, for witness tampering in a trademark infringement case against the use of SCREENIE BEANIES by Softbelly, Inc.

District Court Jude Lefkow found that H. Ty Warner, founder of Ty, Inc., had tampered with an industry expert by persauding him not to appear at trial where he was expected to testify on Softbelly's behalf that BEANIES was generic in the toy industry.

Ty Inc. was ordered to forfeit $716,046 it had won against Softbelly in the case.

Procter & Gamble and Gillette announced their merger last week on January 28, 2005. 

One wonders what the new name might be.  PGGillette, perhaps?

The thought's not original to me.  In fact, a Korean entity named "swing" jumped in to register www.pggillette.com the day the merger was announced.
