View Article  Starbucks versus Star Bock Beer

Confusing patent infringement with trademark disputes, the Puget Sound Business Journal reports that a federal judge in Texas has denied Starbuck's motion for summary judgment in a "patent infringement" case involving the STAR BOCK BEER name.

Apparently, this "patent" case will now proceed to trial on Starbuck's trademark infringement and dilution claims.

My Trademark Transactions LLM course started a new semester a John Marshall Law School in Chicago tonight.

In our introduction, we discussed three guiding principles for taking the role of trademark counsel to a higher level.  These principles no doubt apply to any business lawyer.

1.  Understand the business model.  Trademark lawyers need to do this to provide meaningful opinions.

2.  Find ways to increase value.  Trademark lawyers have may opportunties to guide the company to select and build strong brands.

View Article  Inaccurate Deposit Invalidates Copyright Registration

Survey company Gallup sued a competitor for infringement of the copyright in an employee survey.  The defendant moved to dismiss, contending that the copyright registration was invalid because the deposit submitted in support was not a copy of the work as first published.  Although Gallup filed a supplemental registration to correct the problem, the District Court nevertheless granted summary judgment against Gallup holding that the registration was invalid.
