Parody Sites
by
Mark VB Partridge
on Tue 14 Feb 2006 01:29 PM CST
We previously commented here and here on the famous JibJab parody of Woody Guthrie's "This Land Is Your Land."
Joanna L. Ossinger has a nice article, "The Problem with Parody," in The Wall Street Journal, February 13, 2006. She notes that some parody sites, including JibJab, end up on both sides of the copyright protection issue, fending off infringement claims from the original owner, and also pursuing infringement claims against sites copying their parody. more »

recently produced its first CD featuring 6 original songs. You
can hear some of it and learn about them at www.myspace.com/roberttheband.
The band is selling the CDs at a low price to raise money for more
studio time. If you'd like a copy, complete with handmade cover

Wired Countries, US Lags
by
Mark VB Partridge
on Fri 05 Aug 2005 09:00 AM EST
In a recent New York Times editorial, Thomas L. Freidman, author of "The World Is Flat," laments the lack of legislative concern over the US's lagging position in global broadband connectivity rankings: "Calling All Luddites" (August 3, 2005).
For more on this, see the following:
Foreign Affairs, May/June 2005, "Down to the Wire."
OECD (Organization for Economic Co-operation and Development), Broadband Statistics, 2004 (includes great charts).
Read Friedman's book to see why we should be concerned. more »

THE WORLD IS FLAT: "If you're not worried, you're not paying attention"
by
Mark VB Partridge
on Sun 31 Jul 2005 01:00 AM EST
The World Is Flat (Farrar, Staus and Giroux 2005), by best-selling author, Thomas L. Friedman, is important reading for those of us trying to "sort out" the effects of globalization on intellectual property rights.
Friedman discusses the "flatteners" of globalization, recognizing the international tensions arising from the politics of IP rights (p. 218):
"Who owns what?" is sure to emerge as one of the most contentious political and geopolitical questions in a flat world . . . If you are in the business of selling words, music, or pharmaceuticals and you are not worried about protecting your intellectual property, you are ... more »

The Chicago Daily Law Bulletin, July 13, 2005, has an interesting article by Jerry Crimmins about blogs hosted by Chicago lawyers:
"Dear diary: Today I got a BIG client online."
Mr. Crimmins mentions www.InternetCases.com by Evan D. Brown, which I recommend to persons interested in the types of topics posted here.
P.S. please note that the Daily Law Bulletin site linked above requires a paid subscription.

More trademark law in literature
by
Mark VB Partridge
on Sun 08 Aug 2004 01:59 PM EDT
This from Money to Burn, a thriller by United States District Court Judge James Zagel (p. 202):
[I] spent an hour listening to each protege of mine spend his or her intellectual power on the question of whether BadAss 3.1 would hurt the sales of Mr. Orange Head--a round plastic orange-colored ball with a cute face that, when touched, told short children's stories. BadAss 3.1 was the same orange color over a square shape with a cute face that, when touched, said things like "You smell like puke," "Your boobs droop," "Your dick is teeny." The question is whether ... more »

DaVinci Code Author Dan Brown on Trademark Law
by
Mark VB Partridge
on Wed 28 Jul 2004 02:29 PM EDT
Professor David Becker, a protagonist in Dan Brown's novel Digital Fortress, lectures a punk on trademark law at a bar in Spain (Chapter 55):
"Catchy name. Make that up yourself?"
"Damn Straight," he said proudly. "I'm gonna patent it."
Becker scowled. "You mean trademark it?"
The kid looked confused.
"You'd need a trademark for a name," Becker said. "Not a patent."
"Whatever!" the punk screamed in frustration. more »
