Merck has lost a trademark infringement claim against Canadian pharmacies who purchased keywords to trigger sponsored links.  Merck & Co. v. Mediplan Health Consulting, 2006 WL 800756 (SDNY Mar. 30, 2006).

View Article  Purchasing Competitor's Name As Keyword May Infringe

An online realty agency, TheMLSonline.com, purchased keywords matching the name of a competitor from Google and Yahoo.  Last week, the District Court for Minnesota issued a decision allowing the case to proceed to trial on Edina Realty's claim of trademark infringement.  This may be the first case to reach trial on the keyword issue.  See Edina Realty, Inc. v. TheMLSonline.com, 2006 WL 737064 (D. Minn. Mar. 20, 2006).

View Article  Display of Thumbnail Images Is Likely to Infringe Copyright

The District Court in California ruled on a motion for preliminary injunction that the creation and display of thumbnail images of copyrighted works is likely to constitute copyright infringement and is not fair use. Perfect 10 v. Google, Inc., (C.D. Cal., 2/17/06).  Offering links to infringing images on third-party sites, however, is not copyright infringement.

After the Supreme Court vacated and remanded its prior decision, the Ninth Circuit again reversed the lower court's grant of summary judgment in KP Permanent Make-Up, Inc. v. Lasting Impressions I, Inc. on May 19, 2005.

View Article  ACPA Applies to Noncommercial Use of Domain Name

A recent decision by the Ninth Circuit confirms that "commercial use" by the defendant is required for a Lanham Act trademark or dilution claim, but is not required in a cybersquatting claim under the ACPA.

Michael Kremer, a dissatisfied hair transplant patient, used the domain name www.BosleyMedical.com as a site critical to the Bosley Medical Institute, a hair transplant clinic. Bosley sued. The district court entered summary judgment for Kremer on the grounds that his conduct was not commercial.  See Bosley Medical Institute, Inc. v. View Article  Wal-Mart Recovers Sam Walton Name

Panelist Scott Donahey awards Wal-Mart the domain name www.samwalton.com in this recent decision:  Wal-Mart Stores, Inc. and Mrs. Helen Walton v. Bestinfo/David Webb, Case No. D2005-0086 (WIPO March 25, 2005).

A key issue in UDRP actions involving personal names is the finding that the name is protectable as a common law mark, the the Policy does not provide protection for personal names per se.

The Panel finds as follows on that point:
